Cardi B’s Cover Art Lawsuit Heading to Trial
Cardi B is heading to court next year over the cover art of her debut mixtape.
The 2016 mixtape, “Gangsta B**** Music, Vol. 1”, features Cardi B in a compromising position with an unknown man, whose back is heavily covered with distinctive tattoos.
For the past year, the 28-year-old “WAP” hitmaker has been engaged in a legal battle with model Kevin Brophy Jr., who has accused her of stealing his tattoo design and digitally superimposing it onto the other man’s back.
Now, per a federal court ruling last Friday, 4 December, Cardi B will face a jury trial in 2021 – there, she will fight Brophy Jr.’s claim that she “misappropriated his likeness in a misleading, offensive, humiliating and provocatively sexual way” to launch her rapping career.
To add insult to injury, US District Court Judge Cormac Carney rejected the rapper’s argument that she implemented transformative fair use by incorporating the model’s tattoo into the cover art.
Should Brophy Jr prevail in the trial , he apparently may receive $1.5 million in damages.
